      قال عيسى بن هاشم: وهنا تركنا العصفور قد وقع في الفخ وحولنا السمع إلى ما لا يزال دائرًا بين صاحب القضية وتبيع المحامي:

      التبيع فإذا تبعت رأيي ووافقتني عليه فلا ترفع قضيتك إلى المحاكم الأهلية لأنها فضلا عما فيها من بطء التنفيذ في مثل هذه المسائل فإنها قلما تحكم على الحكومة وإن حكمت كانت الصعوبة في تنفيذ الحكم أما المحاكم المختلطة فإنها لا تخشى أن تحكم على الحكومة بجميع مصالحها والتنفيذ فيها أنفذ من لهم في الرمية كما أن المحاكم الأهلية لا تعرف قدر هذه القضية ومنزلتها من التاريخ ولا تهتدي إلى تقدير فوائدها الماضية من عهد من وضع يده عليها إلى الآن وأوكد لك أنك لا تربح هذه القضية المهمة إلا إذا رفعتها إلى المحاكم لمختلطة ولكن أسألك قبل كل شيء هل الشجرة مذكورة في الحجة باسمها التاريخي وهل نسبك مثبوت الاتصال بالواقف؟

      صاحب القضية أما الشجرة فمذكورة في حجة الوقفية أنها على أرض سواد ومنصوص عنها أنها «شجرة العذراء» وأما نسبي فهو متصل بأحد عتقاء الواقف السلطان الظاهر بيبرس المستحقين في ذلك ولكن من لي بدخول القضية في المحاكم المختلطة؟ ومن لي بمحام أجنبي وقد علمت ما يلزم لهؤلاء المحامين الأجنبيين من المبالغ الجسيمة في مقدم أتعابهم؟

I can assure you that you won’t win this important case unless you take it to the Mixed Courts. But before anything else, tell me about the tree that’s mentioned in the deed with its recognized historical name? Is your own descent traceable back to the endower?

      Plaintiff It’s mentioned in the endowment document as being on arable land and recorded as being “the Tree of the Virgin.” My own descent can be traced back to a freedman of the endower, Sulṭān al-Ẓāhir Baybars, who had rights to it. But how can I bring the case before the Mixed Courts? How can I possibly afford a foreign lawyer when I’m well aware of the huge sums you have to pay them in advance fees?

      التبيع هون عليك الأمر فأما دخول القضية في المحاكم المختلطة فأمر سهل يكون بالتنازل عن القضية لأحد الأجانب وأما المحامي الأجنبي فأنا أتكفل لك بإقناع معلمي الذي اشتغل معه بقبول القضية من غير أن يكلفك دفع شيء من المقدم وغاية الأمر أنه يتفق معك على أن يكون له النصف في ما تأتي به القضية من مبالغ الربح وأما الأجنبي الذي تتنازل له عن القضية فهو تحت يدنا في مكتبنا لمثل هذه المسائل وما عليك الآن سوى النفقات والرسوم القضائية.

      صاحب القضية لا بأس بما تقول ولكن البلاء أنه ليس عندي ما أستغني عنه من النقد لهذه النفقات ويعلم الله أني لو كنت واثقًا بكسب القضيّة لأقدمت على بيع الحصة التي أملكها في الربع ولكني أخشى أن أخسر القضية فتضيع عليّ أسباب معيشتي ومعيشة أولادي.

      التبيع لو تعلم مهارة معلمي وماله من الشأن في المحاكم المختلطة ورفعة مقامه لدى الحكومة واتصاله بالقنصليات لاستخرت الله في بيع ما تملك ولنشطت إلى إقامة الدعوى.

      صاحب القضية استخرت الله تعالى وأعجبني هذا الرأي.

      التبيع إذن قد أذعنتني في الكلام مع معلمي وما عليك إلا أن تحضر لعقد الشروط غدا.
