La presente investigación tiene por objetivo explicar la necesidad que existe en el Estado mexicano para proteger el ambiente desde la perspectiva de los derechos humanos, ante las consecuencias y conflictos ambientales que se viven a partir de la dinámica de la economía del capitalismo tardío, bajo el contexto de la globalización. Básicamente, se analiza la pertinencia de enmarcar el derecho ambiental en los derechos humanos en el caso mexicano para redundar en legitimidad para el Estado. Bajo esta premisa, subyace el hecho de que los Estados contemporáneos se encuentran en situación de crisis de legitimidad, gracias al arribo de la globalización. Con este proceso, cambió radicalmente la forma tradicional de entender a los órganos estatales, así como los recursos que la clase política usa para legitimarse.
