Wie kann die Machtausübung kirchlicher Amtsträger kontrolliert werden? Ein Vorschlag des Synodalen Weges ist die Ermöglichung einer innerkirchlichen gerichtlichen Überprüfung von Verwaltungsentscheidungen auf Ebene der Bischofskonferenz. Matthias Ambros untersucht, ob und wie dieser Vorschlag umgesetzt werden kann. Denn vielen Gläubigen ist nicht bewusst, dass das kirchliche Recht schon jetzt gerichtliche wie außergerichtliche Rechtsbehelfe vorsieht. Sie werden hier vorgestellt, um diesem Defizit entgegenzuwirken, denn auch unabhängig von der Errichtung lokaler Verwaltungsgerichte bleiben sie ein Instrumentarium, mit dem Gläubige ihre rechtlichen Interessen einfordern. Zudem wird die Etablierung einer lokalen Verwaltungsgerichtsbarkeit umso wirksamer sein können, wenn sie vermeidet, allein das staatliche Recht auf die Kirche zu übertragen, sondern Maß nimmt am geltenden kanonischen Prozessrecht sowie der Gerichtspraxis und der ständigen Rechtsprechung der Apostolischen Signatur.
