Uno de los problemas de tipo estructural con más repercusiones de los que afectan a las administraciones públicas españolas a todos los niveles tiene que ver con un sistema de selección del personal que no cumple bien con sus funciones. Esta se realiza por medio de unos procedimientos en ocasiones demasiado rígidos y casi siempre muy desvinculados de las capacidades y competencias realmente necesarias e importantes para desarrollar un buen trabajo al servicio de todos. Además, las estructuras burocrático-administrativas no siempre tienen un diseño de la suficiente calidad como para fomentar desempeños eminentemente profesionales y asegurar que el personal disfrute de las garantías adecuadas para el desarrollo autónomo de sus funciones al margen de los dictados políticos respecto de aquellas cuestiones donde esta interferencia no es deseable. El presente estudio se ocupa específicamente de señalar los problemas e ineficiencias que, a nuestro juicio, se derivan de un modelo de selección del personal de las administraciones que estimamos muy necesario reformar. Por ello, no solo se analizan los defectos del actual sistema, sino que, conservando sus virtudes y examinando los ejemplos de Alemania, Francia, el Reino Unido, Italia, EE. UU. y la Unión Europea, se proponen y razonan toda una serie de modificaciones, tanto sustanciales y estructurales -que vayan a la raíz del modelo-, como otras que podrían ser objeto de una implantación más progresiva, de los sistemas de selección del personal de las administraciones públicas españolas.

The development of digital technologies, capable of analysing massive amounts of data, has led to the widespread implementation of data processing technologies and automated decision-making processes in many areas of human activity. Over the past few years, it has become increasingly apparent that these tools can cause significant harms to the fundamental rights of individuals as well as to other basic values and principles which constitute the very foundation of Western democracies. Most of the legal scholarship and regulators have thus far focused on privacy protection legal instruments as the main mechanisms through which to protect individuals and democratic values against the harms and risks caused by automated data processing and decision-making systems.
This book focuses on analysing how the EU data protection and US privacy protection frameworks are structured and can work in order to prevent and deal, in particular, with algorithmic discrimination, but also other issues of concern, such as automated system opacity. In doing so, the shortcomings of privacy-based protection systems in addressing some of risks and harms caused by data processing and decision-making technologies are also established. Finally, the book also draws a series of regulatory proposals aimed towards effectively addressing the concerns and problems that arise from the growing implementation of automated data processing and decision-making systems.
